Terms of Service

Owner: Fourth King Enterprises (“Fourth King Enterprises,” “we,” “us,” or “our”)

By accessing or using our website, services, or any marketplaces where we offer services (the “Services”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Services.

1) Use of the Services

  • You must use the Services only for lawful purposes and in accordance with these Terms.

  • We may update, modify, suspend, or discontinue any part of the Services at any time. Your continued use after changes are posted means you accept the changes.

  • The Services are provided “as is” and “as available.”

2) Accounts & Content

  • If you create an account, you are responsible for safeguarding your login and for all activity under it.

  • You retain ownership of content you submit. You grant us a worldwide, non-exclusive, royalty-free license to host, display, and use your content solely to operate, improve, and promote the relevant area of the Services.

  • Content posted in publicly accessible areas (e.g., forums, comment sections) may be visible to others. Do not post confidential or proprietary information.

3) Prohibited Conduct

You agree not to:

  • Violate any applicable law or regulation;

  • Infringe others’ intellectual property, privacy, or publicity rights;

  • Upload malware or interfere with the operation or security of the Services;

  • Attempt to access the Services other than through publicly supported interfaces;

  • Copy, sell, resell, or commercially exploit the Services except as expressly permitted.

4) Intellectual Property

All right, title, and interest in the Services, including software, text, graphics, logos, and compilations, are owned by us or our licensors and protected by law. You may not reproduce, modify, distribute, or create derivative works without our prior written consent.

5) Third-Party Links & Tools

The Services may link to third-party websites or tools. We are not responsible for their content, policies, or practices. Your dealings with third parties are solely between you and them.

6) Export Compliance

You agree to comply with all applicable U.S. and international export and sanctions laws and not to use or provide the Services where prohibited.

7) Accessibility / Closed Captioning

We aim to make our content reasonably accessible and will comply with applicable rules regarding captioning of video content, where required.

8) DMCA / IP Complaints

If you believe your intellectual property has been infringed, please send a notice including: (a) the authorized signer’s physical or electronic signature; (b) a description of the work claimed to be infringed; (c) the location (URL) of the material; (d) your contact information; (e) a statement that you have a good-faith belief the use is not authorized; and (f) a statement under penalty of perjury that the notice is accurate and you are authorized to act.

9) Warranties & Disclaimers

YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, secure, error-free, or that defects will be corrected.

10) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOURTH KING ENTERPRISES AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION) ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY. Our total liability for any claim shall not exceed the amount you paid (if any) to use the Services in the 3 months preceding the claim.

11) Indemnification

You agree to defend, indemnify, and hold harmless Fourth King Enterprises and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your content, or your violation of these Terms or applicable law.

12) Changes to the Services or Terms

We may change the Services and these Terms from time to time. Updates are effective when posted. If you do not agree to the updated Terms, stop using the Services.

13) Termination

We may suspend or terminate access to the Services at any time, with or without notice, for any reason. Sections that by their nature should survive (e.g., IP, disclaimers, limitations of liability, indemnity, governing law) shall survive termination.

14) Governing Law & Venue

These Terms are governed by the laws of the State of Illinois, without regard to conflicts of law. You agree to the exclusive jurisdiction and venue of the state courts in Jo Daviess County, Illinois or the U.S. District Court located in Illinois for all disputes arising out of or relating to these Terms or the Services.

15) Statute of Limitations

Any claim arising out of or related to the Services or these Terms must be filed within five (5) years after it arose, or be forever barred.

16) Miscellaneous

  • Entire Agreement: These Terms constitute the entire agreement between you and us regarding the Services and supersede prior or contemporaneous agreements.

  • Severability: If any provision is found unenforceable, the remainder remains in effect.

  • Waiver: Our failure to enforce a provision is not a waiver of our right to do so later.

  • Third-Party Beneficiaries: None, unless expressly stated.
